These Terms & Conditions apply to bookings, access, and use of SculptClub and sculptclub.nl.

2. Scope
These Terms & Conditions govern:
- the use of the SculptClub website (sculptclub.nl);
- all bookings made for the SculptClub studio;
- access to and use of the SculptClub facility in Amsterdam.
By making a booking or using the studio, you agree to these Terms & Conditions.
3. Bookings, access & time slots
SculptClub operates as a self-service studio with booked private time slots.
- Booking required: Access is only permitted with a valid booking.
- Access code: You receive a door code for your booking. The code is personal and linked to your reservation.
- No code sharing: You may not share your code or give access to unauthorized persons.
- Time slot discipline: You must respect your booked time and leave the space on time so the next user can start their session.
- Entry/exit timing: Arrival and exit windows may be limited (for example, max. a few minutes before/after your session), as communicated in the booking confirmation or house rules.
- Capacity limit: The maximum number of people in the studio at any given time is the limit communicated by SculptClub for that booking type and/or as required by applicable rules.
Violation of access or time-slot rules may lead to a warning, additional charges for extra time used, suspension of access, or cancellation of future bookings.
4. Prices, payment & invoices
- Prices shown during booking (or agreed in writing) apply to your reservation.
- Payment methods are those offered during checkout or agreed in writing.
- If invoicing is used, payment terms stated on the invoice apply.
- Credit packs, if offered, are subject to the conditions stated on the product/checkout page (including validity period and usage rules).
5. Cancellations & rescheduling
The cancellation and rescheduling policy shown during checkout and/or in your booking confirmation applies to your booking.
If no separate cancellation policy is shown at checkout, SculptClub may apply a reasonable cancellation policy based on the reserved time slot and operational planning.
Important: Nothing in these Terms & Conditions limits any mandatory consumer rights that apply under Dutch or EU law.
6. House rules & use of the studio
To keep the space safe, clean, and usable for everyone, users must follow the SculptClub house rules (as displayed in the studio, shared by message, and/or published on the website).
These include, among others:
- treat equipment and the space with care;
- return equipment to its place after use;
- avoid unnecessary noise and nuisance for neighbors;
- do not drop weights in a way that may damage the building, floor, or equipment;
- leave the space tidy after your session;
- close and lock the door properly when leaving (if applicable).
SculptClub may update house rules from time to time to improve safety, operations, or neighbor relations.
7. Independent personal trainers & professional use
If you book the studio as a personal trainer, coach, or other professional and train a client at SculptClub:
- you remain fully responsible for your own services, coaching, programming, and professional conduct;
- you are responsible for the safety and suitability of your session for your client(s);
- you are responsible for ensuring you have any insurance required for your work (including professional liability insurance, where applicable);
- you must ensure your client(s) also follow the house rules and these Terms.
8. Health, safety & liability
Training with weights and exercise equipment involves inherent risks. You use the studio and equipment at your own risk.
- User responsibility: You are responsible for your own health condition, exercise choices, and safe use of equipment.
- Personal belongings: SculptClub is not responsible for loss, theft, or damage to personal belongings, except where liability cannot be excluded under applicable law.
- Damage caused by user: You may be held responsible for damage caused by intentional misuse, negligence, or breach of these Terms/house rules.
- Legal limitation: Nothing in these Terms excludes or limits liability where exclusion is not permitted by law (for example in cases of intent, gross negligence, or mandatory consumer protections, where applicable).
9. Camera surveillance (CCTV)
SculptClub uses camera surveillance for safety, security, protection of property, and incident handling.
- Cameras are not placed in private areas such as toilets or changing areas.
- Visitors are informed about camera surveillance (for example through signage and/or information on-site).
- Camera footage is handled in accordance with applicable privacy laws and SculptClub’s Privacy Policy.
- Footage is only accessed when needed (for example for security incidents, safety issues, misuse, or legal obligations).
- Footage is not kept longer than necessary, unless retention is required for an incident, investigation, or legal obligation.
10. Website use
- You may not misuse the website, booking system, or contact forms.
- You may not attempt unauthorized access to systems or data.
- SculptClub may suspend access to the booking system in case of fraud, abuse, or repeated violations.
11. Privacy
SculptClub processes personal data for bookings, communication, access management, and customer support. Please also review the SculptClub Privacy Policy for details on data processing, retention, and your rights.

13. Changes to these Terms
SculptClub may update these Terms & Conditions from time to time. The version published on the website applies to new bookings from the publication date. If a change materially affects an existing booking, SculptClub will communicate this where reasonably possible.
14. Governing law & disputes
These Terms & Conditions are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless mandatory law provides otherwise (for example, mandatory consumer jurisdiction rules).
