1. Who we mean

SculptClub: that’s us, the gym in Amsterdam, registered with the Chamber of Commerce under number 64708101

Member / participant: that’s you, if you take out a membership or enter into any other agreement with us.

Contract / membership: the agreement between you and us, which gives you access to our facilities and/or classes.

2. Membership and duration

You register via our form; always complete it honestly and fully.

By becoming a member, you declare that you are healthy enough to participate. You always train at your own risk.

Your membership runs for the agreed period. If you do not cancel, it will automatically renew for one month.

Cancellation must be done in writing or by email, with a notice period of one full calendar month. Verbal cancellations are not valid.

We may adjust our prices annually (e.g., due to VAT changes) and index them by a maximum of 5%.

3. Payments

Membership fees are collected via direct debit.

If a direct debit fails, you will receive a reminder. If payment is still not made, we may charge administrative fees and statutory interest and block your access.

Repeated non-payment may result in termination of your membership.

4. Use of our facilities

You may use the club during opening hours and only with a valid membership.

Your membership is personal – it cannot be transferred.

We may adjust classes, opening hours, and trainers if necessary. This does not entitle you to a refund of membership fees.

5. Booking and cancellation

For group classes or personal training, booking may be required.

Cancellations must be made at least 24 hours in advance. If you cancel later or do not show up, the class will be forfeited without reimbursement.

6. Pause or termination

If a medical reason prevents you from training temporarily, you may suspend your membership. You must notify us in writing and provide proof.

Please note that payment obligations generally continue unless otherwise agreed.

In cases of misconduct, repeated non-payment, or violation of house rules, we may terminate your membership immediately.

7. House rules and behavior

We aim for a safe and pleasant club. Always follow the house rules (available in the club and on the website).

Respect for others and for the equipment is mandatory.

Dangerous, disruptive, or inappropriate behavior may result in being denied access and membership termination without refund.

8. Liability

You always train at your own risk.

SculptClub is not liable for injuries, theft, loss, or damage, unless caused by our intent or gross negligence.

Make sure you have sufficient insurance yourself (e.g., through your health insurance).

9. Force majeure

Sometimes events beyond our control occur (fire, pandemic, government measures, renovations).

In such cases, we may adjust our services or temporarily close without compensation. We will always seek an appropriate solution.

10. Privacy

We handle your data responsibly and comply with the GDPR.

Your data will only be used for administration and to allow you to train safely.

You always have the right to access, correct, or delete your data.

11. Intellectual property

Our programs, methods, and materials remain the property of SculptClub.

It is not permitted to copy or distribute these without permission.

12. Applicable law

Dutch law applies to our agreements.

Any disputes will be submitted to the competent court in Amsterdam.

These terms and conditions are effective from August 19, 2025, and replace all previous versions.
